Disclosures that are alleged to be “prior art” may sometimes have uncertain status.

What are the requirements for relevant technical information truly to become part of the state of the art? When is a disclosure enabling (and when is it not)?

The law and practice of the European Patent Office will be reviewed in this session to examine when a disclosure in the “grey area” is not prior art, covering Internet disclosures, the automated generation of virtual chemical structures and many other examples.
